What Are Accident Benefits?

Income Replacement Benefit (IRB)

If you have suffered a substantial inability to perform the essential tasks of your employment, IRB may be available to you. IRB is equal to 70% of your pre-accident gross income at a maximum of $400.00 per week.

Non-Earner Benefit

If you have suffered a complete inability to carry on a normal life as a result of an accident and within 104 weeks after the accident, you do not qualify for the income replacement benefit, then the non-earner benefit may be available to you. The non-earner benefit is $185.00 per week.

Medical Rehab Expenses

It is important to note that OHIP does not cover all rehab expenses in Ontario and depending on the severity of your injury; medical rehab expenses may be available to you. There are three levels of medical rehab benefits being minor injury, catastrophic and non-minor non-catastrophic.

Minor Injury

Defined as one or more of a sprain, strain, whiplash associated disorder, contusion, abrasion, laceration and any clinically associated condition which is the consequence of a previous disease or injury. minor injury benefits are capped at $3,500.00.

Catastrophic Injury

Examples include paraplegia, loss of vision, brain injury, mental impairment. Catastrophic injury has a maximum medical rehab benefit of 1 million dollars for life.

Non-Minor and Non-Catastrophic

Most represented claimants fall under this category. These claimants fall in the middle of a minor or catastrophic injury. These injuries have a maximum benefit of $65,000 together with attendant care for up to 5 years.
